Domestic Workers

Firstly, if you employ a Domestic Worker you are deemed to be an “Employer”, which means most legislative requirements that an ordinary employer needs to conform to, now apply to you as well.

Secondly, Domestic Workers now have all the same rights as employees employed in the formal sector so even if you only employ someone for a week of the month you are expected to carry out certain duties and adhere to all legal responsibilities.

Unfortunately, so many employers of Domestic Workers aren’t aware of these requirements and as such run a very high risk of falling foul of the various labour and tax laws and rules governing Domestic Workers and thus could face severe and costly repercussions.

More importantly, they could spend time at the CCMA, which for most, is not always a pleasant experience.
